Terms of Service

The Service

WhyAds helps businesses create advertising on Google and Meta: it analyzes your website, generates ad designs and copy, plans campaigns and, with your approval, creates and manages them in advertising accounts that you own and connect. Features may change as we improve the Service.

Eligibility and accounts

You must be at least 18 years old and use the Service for business purposes. You are responsible for the information you provide, for keeping your password secure and for all activity in your account. Tell us right away at support@whyads.app if you suspect unauthorized access.

Your approval and your advertising

• Nothing is published in your advertising accounts without your approval. When you approve a campaign or change, you are responsible for it as the advertiser.
• You are responsible for making sure your ads, products, landing pages and targeting comply with the law and with the policies of Google, Meta and any other platform, including restrictions on special ad categories such as housing, employment, credit and social issues.
• You set a daily spend cap per business. WhyAds will not knowingly exceed it and will not raise a budget on its own, but platforms can deliver slightly above a daily budget on some days, as they explain in their own terms.

Ad spend and payments

Your ad spend is billed to you directly by Google, Meta or the relevant platform, with your own payment method, under their terms. WhyAds never receives or handles your ad spend.

Access to the Service uses credits. New accounts receive free trial credits. Paid plans and credit packs, when available, will be described in the app with their price before you buy, will be processed by PayPal and will renew as stated at purchase until you cancel. Unless the law requires otherwise, payments are non-refundable, and unused credits do not carry over beyond what your plan states. Credits have no cash value.

AI-generated content

The Service uses artificial intelligence to generate designs, copy and recommendations. AI output can be inaccurate, incomplete or similar to content created for others. Review it before approving. We do not guarantee any specific advertising result, such as clicks, leads, sales or cost per result.

Your content and ours

You keep all rights to the content you provide (such as your logo, images and texts) and to the ads generated for you, to the extent permitted by law. You give us a limited license to use that content only to provide and improve the Service for you. You confirm that you have the rights to the content you provide.

The Service, including its software, design and brand, belongs to WhyAds and its licensors. These Terms do not give you any rights to it other than to use the Service.

Acceptable use

Do not use the Service to break the law, infringe the rights of others, advertise prohibited products, create misleading or discriminatory ads, send spam, scan websites you don't own or are not authorized to scan, interfere with or reverse-engineer the Service, or create multiple accounts to obtain free credits.

Third-party platforms

The Service works with Google, Meta and other third-party services that have their own terms and policies. We are not responsible for their availability, decisions (such as ad disapprovals or account restrictions) or changes to their products.

Suspension and termination

You can stop using the Service and delete your account at any time (see Data Deletion). We may suspend or close accounts that violate these Terms or put the Service, other users or the platforms at risk. Sections that by their nature should survive termination will survive it.

Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent permitted by law, WhyAds will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or ad spend. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim.

Changes to these Terms

We may update these Terms. If the changes are material, we will notify you by email or in the app before they take effect. If you keep using the Service after that, you accept the new Terms.

Governing law

These Terms are governed by the laws of Chile, without prejudice to any mandatory consumer protection laws of your place of residence that apply to you.
